§ 163. Special Services Homes.

  • (a)

    Special services homes include:

    (1)

    Homes for the handicapped, aged or infirm;

    (2)

    Nursing and intermediate care homes;

    (3)

    Child care homes; and

    (4)

    Halfway houses. (Use classifications 1.410, 1.420, and 1.430.)

    (b)

    The minimum room sizes in a special services home shall be one hundred fifty (150) square feet for a living or principal room, one hundred (100) square feet for a kitchen and dining room combination, one hundred (100) square feet for the first bedroom, and seventy (70) square feet for each additional bedroom.

    (c)

    The issuance of a permit for a special services home shall be conditioned upon the applicant obtaining any required state license within ninety (90) days after approval of the permit.

    (d)

    No special services home shall house mentally ill persons who are determined to be dangerous to others as defined in G.S. Section 122C-3(11)b.

    (e)

    Signage shall be limited to a nameplate not to exceed two (2) square feet in area.

    (f)

    The applicant shall submit to the permit-issuing authority a statement addressing the number of staff personnel to reside in the facility and their backgrounds and qualifications; the number of individuals to be housed in the facility, the purpose of the facility, and the nature of the handicap of the individuals who will reside there; and the intake criteria which have been or will be used in screening the persons who will live in and benefit from the facility.

    (g)

    In order to prevent a concentration of special services homes in residential districts, no such home shall be located within one thousand three hundred twenty (1,320) feet of another such facility, measured along a straight line from property line to property line.
