§ 1-12. Penalties and remedies for Code violations.

  • (a)

    The penalties and remedies set forth herein shall apply to violations of the provisions of the Town Code unless and to the extent other provisions provide different penalties or remedies for specific violations.

    (b)

    Except as otherwise provided in section 19-165, a violation of any town ordinance regulating the operation of a vehicle shall constitute an infraction, punishable as provided in G.S. §§ 14-3.1 and 14-4.

    (c)

    Except as otherwise provided in this Code, a violation of any of the provisions of this Code shall constitute a Class 3 misdemeanor, punishable by a fine of not more than five hundred dollars ($500.00).

    (d)

    Except as otherwise provided in this Code, a violation of the provisions of this Code shall also subject the offender to a civil penalty of fifty dollars ($50.00). If a person fails to pay this penalty within ten (10) days after being cited for a violation, the town may seek to recover the penalty by filing a civil action in the nature of debt.

    (e)

    The town may seek to enforce the provisions of this Code through any appropriate equitable action.

    (f)

    Each day that a violation continues after the offender has been notified of the violation shall constitute a separate offense.

    (g)

    The town may seek to enforce the provisions of this Code by using any one (1) or a combination of the foregoing remedies.
