§ 20-158. Area lighting service rate, AL.

  • (a)

    Applicability. This schedule is applicable to electric service supplied in the lighting of outdoor areas by means of luminaries mounted on brackets extending six (6) feet or less from a town-owned wood pole on which secondary conductors exist or can be extended.

    (b)

    Type of service. Outdoor area lighting service is supplied in accordance with a customer's written application and agreement and under the town's electric ordinance and this schedule. The service supplied by the town will include furnishing and installing the lighting units requested by customers and connecting the lighting units to the town's system, all in accordance with the town's standards and requirements. Such facilities, with automatic controls, will be owned, maintained and operated by the town, and the town will furnish the electricity required for the illumination of the lamps during the hours of darkness.

    (c)

    Maintenance. The town will perform as soon as practical, during regular working hours, the necessary maintenance to restore illumination after a customer has notified the town that a lamp is not burning.

    (d)

    Monthly rate. For lighting units mounted on a wood pole, the schedule of rates applicable to this section shall be in an amount determined from time to time by the council and listed in the schedule of fees maintained in the clerk's office.

    (e)

    Contract. This service will only be provided after a regular contract is entered into between the town and the customer, which contract shall be in the form and with such provisions as may be approved by the town attorney. The contract period shall be not less than three (3) years and shall extend from year to year thereafter until terminated by the customer or the town. If a customer desires to terminate the agreement before the expiration of the initial contract period, the town will agree to such termination, provided the customer pays to the town a sum of money equal to forty (40) percent of the bills which would otherwise have been rendered for the unexpired months in the initial contract period. The contract provided for in this rate schedule shall be signed by the person in whose name the electric service is provided and for the town by the director of electric utilities.
